UK Family Law and the LGBTQIA community

Be assured that we don’t just jump on the Pride Month bandwagon to ‘show our support’ for the LGBTQIA community. All year round we are helping gay, lesbian, bisexual, transgender, transsexual and intersex couples with family law issues. However, Pride Month does help to bring these issues into focus and demonstrate that support is available.

I am worried about shared parenting! How can it possibly work?

Despite gay and lesbian couples having the same rights as heterosexual couples, we know that LGBTQIA families still face a number of unique considerations and challenges. LGBTQIA couples and families do have many of the same legal issues as heterosexual couples, but there are matters that are unique to same-sex relationships.

That’s why partnering with a family law firm who understand those unique matters is vital. We can help you and your family with all aspects of the law.

Divorce & civil partnership dissolution

If your relationship has broken down, we can support you with an application for divorce or dissolution of a civil partnership or we can help you respond to an application from your former partner.

We can handle all aspects of ending your relationship, including dealing with your finances, dividing your assets and making arrangements for any children that you have together.

Living together agreements

If you are not married or in a civil partnership, but you’re living together, a living together agreement helps to outline the terms of your cohabitation. The agreement can cover contributions that will be made by each party to rent or mortgage repayments and bills, and what rights each party will have to assets should your relationship end.

Parenting arrangements

LGBTQIA couples and families can sometimes find themselves in complicated parenting situations. For example, perhaps you have a child from a previous heterosexual relationship, but now you are in a same-sex relationship.

Under these kinds of circumstances, a formal parenting agreement can help bring clarity to everyone over their roles, rights and responsibilities, which allows for a more stable and positive environment for children.

LGBTQIA family mediation

In most LGBTQIA family cases, issues can be resolved through family mediation, rather than in the family courts. In fact, the Court is unlikely to hear a case unless mediation has first been considered.

Are you friends behaving badly during your divorce?

The mediation process involves all parties sitting down with a trained mediator who will help guide proceedings towards a mutually acceptable agreement. Mediation is often the fastest, most cost-effective and least stressful way to resolve family legal matters – including divorce and civil partnership dissolution.
